Welcome to the National Society of Autism Professionals ("NSAP," "we," "us," or "our") website. These Terms of Use ("Terms") govern your access to and use of our website, member portal, forums, and any related digital properties
(collectively, the "Site"). By accessing or using the Site, you agree to be bound by these Terms. Please read them carefully.
We may update these Terms at any time. If we make material changes, we will post the updated Terms on the Site. Your continued use of the Site after any changes are posted constitutes your acceptance of the revised Terms. If you

1. Eligibility
The Site is intended solely for autism care professionals who are at least 18 years of age. By using the Site, you affirm that you are at least 18 years old and have the right and authority to enter into these Terms. You further
represent and warrant that all information you provide to us is accurate, current, and complete.
NSAP membership is available to licensed, credentialed, or otherwise qualified autism care professionals across all relevant disciplines. NSAP reserves the right to verify credentials and to deny or revoke membership at its
discretion.
2. Membership & Accounts
NSAP membership is a paid subscription. Membership dues are billed on a recurring basis as described at the time of registration. You authorize us to charge your designated payment method for all applicable fees. All fees are
non-refundable except as required by applicable law or as expressly stated in our refund policy.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at
[email protected] if you suspect any unauthorized use of your account. NSAP is not liable for any loss or damage arising from your failure to maintain the security of your credentials.
You may cancel your membership at any time through your account settings or by contacting us. Cancellation will take effect at the end of your current billing period.
3. Acceptable Use
You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Site in any way that violates applicable federal, state, or local law or regulation
- Impersonate any person or entity or misrepresent your professional credentials or affiliation
- Post or transmit any content that is unlawful, defamatory, harassing, abusive, fraudulent, obscene, or otherwise objectionable
- Harvest, scrape, or collect information about other members without their consent
- Use automated tools, bots, or scripts to access or interact with the Site
- Reproduce, duplicate, copy, sell, or exploit any portion of the Site for commercial purposes without our express written consent
- Attempt to gain unauthorized access to any portion of the Site or its related systems
- Interfere with or disrupt the integrity or performance of the Site
- Use the Site to advertise, solicit, or promote any goods or services without our prior written approval
NSAP reserves the right to remove any content and suspend or terminate any account that violates these Terms, without notice and at our sole discretion.
4. Member Forums & User-Generated Content
The Site includes member forums and profile features where you may post content, comments, and other materials ("User Content"). You retain ownership of your User Content, but by posting it you grant NSAP a non-exclusive,
royalty-free, perpetual, irrevocable, and fully sublicensable license to use, reproduce, modify, adapt, publish, and display such content in connection with the Site and NSAP's mission.
You represent and warrant that: (i) you own or have the necessary rights to post your User Content; (ii) your User Content does not infringe the intellectual property, privacy, or other rights of any third party; and (iii) your User
Content complies with these Terms.
NSAP does not endorse any User Content and takes no responsibility for content posted by members. We reserve the right, but not the obligation, to monitor, edit, or remove any User Content at our discretion.
Member forums are intended for professional discussion related to autism care. Personal attacks, harassment, discriminatory language, and off-topic commercial solicitation are strictly prohibited.
5. Intellectual Property
The Site and all content, materials, and features made available through it - including but not limited to text, graphics, logos, icons, images, audio and video clips, and software - are the property of NSAP or its licensors and are
protected by U.S. and international copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial professional purposes as an NSAP member. You may not reproduce, distribute, modify, create
derivative works of, publicly display, or otherwise exploit any content from the Site without our prior written consent.
You may not use any NSAP name, logo, or trademark without our prior written permission. You may not frame or use framing techniques to enclose any NSAP trademark or proprietary content without express written consent.
6. Third-Party Links
The Site may contain links to third-party websites or resources. These links are provided for your convenience only. NSAP does not own, operate, or control any third-party sites and is not responsible for their content, accuracy, or
practices. The inclusion of any link does not imply NSAP's endorsement of that site. You access third-party sites at your own risk and subject to their own terms and privacy policies.
7. Disclaimers
The site and all content, materials, and services provided through it are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied. NSAP expressly disclaims all warranties, including
but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
NSAP does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. Content on the Site, including member forum posts, is provided for informational and professional discussion
purposes only and does not constitute clinical, legal, or financial advice.
8. Limitation of Liability
To the fullest extent permitted by applicable law, NSAP, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages - including but
not limited to loss of profits, data, or goodwill - arising out of or in connection with your use of or inability to use the site, even if NSAP has been advised of the possibility of such damages.
In no event shall NSAP's total liability to you for all claims arising out of or relating to these Terms or your use of the Site exceed the amount you paid to NSAP in the twelve (12) months preceding the claim.
9. Indemnification
You agree to indemnify, defend, and hold harmless NSAP and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys'
fees) arising out of or relating to: (i) your use of the Site; (ii) your User Content; (iii) your violation of these Terms; or (iv) your violation of any rights of a third party.
10. Dispute Resolution & Arbitration
Please read this section carefully. It affects your rights by requiring arbitration of disputes rather than jury trials or class actions.
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site ("Dispute") shall be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules and
Procedures, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights.
The arbitration shall take place in Contra Costa County, California, or, at your election, by video or telephone. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent
jurisdiction. You and NSAP each waive the right to a jury trial and the right to participate in a class action or class-wide arbitration.
Before initiating arbitration, you agree to first contact us at [email protected] and provide a written description of the Dispute and your desired resolution. We will attempt in good faith to resolve
the Dispute within thirty (30) days.
11. Governing Law
These Terms and any Dispute arising out of or relating to them shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. To the extent any matter is
not subject to arbitration under Section 10, you consent to the exclusive jurisdiction of the state and federal courts located in Contra Costa County, California.
12. Termination
NSAP reserves the right to suspend or terminate your access to the Site and your membership at any time, with or without cause and with or without notice, including for any violation of these Terms. Upon termination, your right to
use the Site will immediately cease. Sections of these Terms that by their nature should survive termination - including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution - shall
survive.
13. Miscellaneous
These Terms, together with our Privacy Policy, constitute the entire agreement between you and NSAP with respect to the Site and supersede all prior agreements. If any provision of these Terms is found to be unenforceable, that
provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
NSAP's failure to enforce any provision of these Terms shall not be deemed a waiver of its right to do so in the future. You may not assign your rights or obligations under these Terms without NSAP's prior written consent. NSAP may
assign its rights and obligations freely.
